Terms of Service

These Terms of Service ("Terms") govern your use of the Alive Still app ("the App"), developed by Jordan Blum ("we", "us"). By using the App, you agree to these Terms.
1. What Alive Still Does
Alive Still is a personal safety check-in app. You set a schedule, and if you don't check in on time, the app sends an alert to your designated emergency contacts via SMS or email.
Important: Alive Still is a supplementary safety tool, not a substitute for emergency services. In an emergency, always call 911 (or your local emergency number). We cannot guarantee message delivery, and the app should not be relied upon as your sole safety system.
2. Eligibility
You must be at least 13 years old to use Alive Still. By using the App, you represent that you meet this requirement.
3. Your Account & Data
- Alive Still uses your Apple ID via iCloud for data sync. You are responsible for maintaining the security of your Apple account.
- You are responsible for providing accurate emergency contact information.
- You must have your emergency contacts' consent before adding them to receive alerts.
4. Emergency Contacts
- By adding someone as an emergency contact, you confirm you have their permission to receive automated SMS or email alerts from the App.
- Alert messages will include your name and indicate that you may need a wellness check.
- We are not responsible for actions taken (or not taken) by your emergency contacts in response to alerts.
5. Subscriptions (Alive Still+)
- Free tier: Core safety features — 1 emergency contact, daily check-ins.
- Alive Still+: Premium features — up to 5 contacts, flexible schedules, verified check-in.
- Subscriptions are billed through Apple's App Store. Pricing, renewal, and cancellation are governed by Apple's terms.
- Free trials automatically convert to paid subscriptions unless cancelled before the trial ends.
- You can manage or cancel subscriptions in your iPhone Settings → Apple ID → Subscriptions.
6. Acceptable Use
You agree not to:
- Use the App to harass, stalk, or send unwanted messages to anyone.
- Add emergency contacts without their knowledge or consent.
- Intentionally trigger false alerts.
- Attempt to interfere with the App's infrastructure or other users' experience.
- Reverse-engineer, decompile, or disassemble the App.
7. Service Availability
- We strive to keep the App reliable, but we cannot guarantee 100% uptime or message delivery.
- The App depends on third-party services (Apple iCloud, Twilio, internet connectivity) that are outside our control.
- We may update, modify, or discontinue features at any time.
8. Limitation of Liability
Alive Still is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any damages arising from your use of the App, including but not limited to: failure to deliver alerts, delayed alerts, missed check-ins, or actions taken by emergency contacts. This app is not a medical device or emergency service.
9. Indemnification
You agree to indemnify and hold harmless Jordan Blum and any affiliates from claims arising from your use of the App, including misuse of the emergency contact feature.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the State of New York, United States.
